Rules and Regulations of the High Bar Harbor Yacht Club Condominium Association, Inc.

1. No overboard discharge in the Marina of any treated or untreated waste is permitted. Waste tank pump-outs are available for a $5.00 charge to members or renters. Members and renters are required to give Marina manager prior notice as to when a pump out will need to be performed on a boat. A sign-up sheet will be available for this purpose. Except for true emergencies, pump outs will not be performed on weekends.

2. All petroleum products (waste oil, etc.), paint, antifreeze, toxic materials, etc., shall be taken to appropriate off-site disposal facilities.

3. No abusive conduct or actions or inappropriate/offensive behavior which might interfere with the rights, comforts and convenience of other boaters, or any illegal actions, will be permitted at the Marina.

4. Musical instruments, stereos, radios, televisions, or any other noise-emitting devices of any nature shall not be played at a volume which can be heard outside the craft between the hours of 9:00 p.m. and 9:00 a.m. Excessive noise is prohibited at all times.

5. All children under the age of 16 must be accompanied by a parent or guardian while at the Marina/HBHYC property, who will be responsible for their safety and conduct. An owner or slip assignee is responsible for the conduct of the guest(s) and/or children of that slip owner or assignee.

6. Any pets brought to the Marina must be leashed/restrained properly.  Pet owners are responsible for cleaning up after their pet and disposing of the waste properly. Fines will be imposed on pet owners who neglect to do so. Pets, (except certified service dogs), are not permitted in the clubhouse at any time.

7. Chartering or soliciting for charter is expressly prohibited on the Marina premises/HBHYC property.

8. All craft must be operated safely and prudently within the Marina and the entrance thereto. All craft will be operated in such a manner as to create a minimum of wash/wake in the Marina. In the event anyone operates the craft in a negligent manner to cause excessive wash\wake, then the craft’s owner, regardless of whether he/she is the operator of the craft, shall be responsible for any damage/injury that is a result thereof (State and Federal Law).

Swimming is completely forbidden within the Marina (Note: This could represent an electrocution hazard.) Exception: Commercial diving for repair/maintenance purposes.

9. All docks, walkways, piers, and finger piers must at all times be neat and uncluttered and clear of tackle, gear and accessories.  Nothing, including steps used to access vessels, should be affixed in a way that impedes the safe and unobstructed passage of individuals and dock carts. Bicycles, motorcycles, scooters, or other wheeled personal conveyances are not permitted to be operated on the docks.

10. Boat owners and users are responsible for the secure mooring of the craft as required by the dockage. In the event the craft is not properly moored in the opinion of the Dockmaster/Manager or other Association employees, the Association may take all necessary action to properly moor craft. All vessels moored in the Marina must be appropriately secured to prevent damage to any other vessel or HBHYC property.  Adequacy of mooring is at the discretion of the Marina Manager and HBHYC employees.  If judged inadequate, this will be discussed with the owner, and if the owner is not available, the Manager may re-tie the boat.

Dock lines shall be, at a minimum, of the following sizes:
– up to 25’-foot length – 1/2″
– 25′ 40’-foot length – 5/8″
– 41′ foot and above 3/4″

11. All vessels leaving the Marina for longer than three days must notify the Association or its agent prior to departure.

12. Cleaning of fish is permitted only within the galleys of vessels or the designated fish cleaning site located on the south-side of the premises. Fish carcasses are not to be dumped into the water within the Marina premises. Bags will be provided at the fish cleaning site so that carcasses can be bagged and thrown away in the designated freezer boxes.

13. Cooking with open flames shall not be permitted in the cockpit of any vessel or on any dock in the Marina.

14. The clubhouse will be open from 8:00 a.m. until 12 midnight.

15. Children ages 16 and under, utilizing the clubroom or pool, must be accompanied by an adult at all times. Pets are not permitted in the clubhouse at any time.

16. The clubhouse is equipped with a combination access lock. Adult members will receive the combination code from the Marina Office. The combination is not to be given to children or non-members.

17. Smoking is not permitted in the clubhouse, deck, and pool area.

18. The clubhouse is for the use of renters and slip owners only.

19. Persons using the kitchen are expected to clean up after themselves, including washing, drying, and putting away utensils, dishes, pots and pans, and cleaning counter spaces and tables after use.  If you use the dishwasher, use judgement and either “run it”, or share a load with someone else and “run it”.  It should be emptied when the cycle is done by those who used it. “Leave it the way you would like to find it!!”

If you use a restroom, please clean up after yourself and leave no personal belongings.

20. The exercise room is available to owners and seasonal renters 16 years of age or older.

Members and renters may use the washers and dryers located in the laundry room. They are available on a first-come first-serve basis, and no one shall leave laundry in any machine after the cycle has been completed.  No tints or dyes shall be used in any machines.  Washing and/or drying of rugs, oily rags, sails, sail covers, or other heavy items is forbidden.

21. Overnight parking of trailers, campers, mobile homes, or tents is not permitted on HBHYC property including in the parking lot.  Any car not properly parked within a marked space, without a contact number or keys left in the vehicle or the Manager/Marina Office may be towed, if necessary, at the owner’s expense. No unlicensed/unregistered vehicles are allowed on HBHYC property.

22. No fueling is allowed in the Marina.  Any reserve fuel (such as for fueling a dinghy) must be in an NFPA and OSHA approved container.

23. A set of keys or lock combinations each vessel, and instructions for silencing security alarms, if any, shall be provided, upon request, to the Association or its designated agent.

24. In the event of storms, owners of vessels moored at the Marina shall be responsible for securing their craft appropriately. If damage to the docks is deemed to be the result of improper mooring of a vessel, then the owner/tenant will be responsible for the cost of the repairs.

25. Storage boxes are permitted on the docks of the Marina, but must not restrict the access of the walkway. Only one dock box is permitted per slip and must be constructed of white fiberglass. Location of the box is regulated by the Marina Manager.  Maximum dimensions are: 27″ deep x 30″ height x 72″ width.

Any additions or alterations to HBHYC property including dock edging, cleats, storage boxes, painting, attached steps, etc. must be approved by the Marina Office.

26. The running of engines is permitted for warm-up or maintenance purposes only (5-10 minutes), or in the case that shore power is not available.

27. Except for Marina antennae, aerials of any nature shall not be attached to or hung from the docks, pilings or other Marina structures.

28. No outside hanging of laundry is permitted.

29. No electric sanding or scraping of craft or gear is permitted.  However, general maintenance is permitted between the hours of 9:00 a.m. and 5:00 p.m.

30. Telephone and television cable service will be available to slips and shall be paid for directly by the boat owner. Electricity for the slip will be sub-metered and shall also be paid for directly by the boat owner. Because there is a single water metering system for the Marina, the Association shall have the right to determine user charges for water and impose user fees based on the amount of water used.

31. All lines running from a vessel to the pier including outlets and power posts at the slip, including all power lines for electricity, telephone, T.V. and cable and water lines, shall be secure and neatly maintained.

32. Boat and slip owners and users shall take no action to cause an increase in the insurance rates or cancellation of the insurance on the Condominium members.

33. Every vessel shall be kept clean and in a good state of repair. Vessels must be seaworthy and capable of moving under their own power at all times.  Demonstration of this may be requested by Management/Board of Trustees once/season by navigation of the vessel under its own power (not sail), from the slip, out the Marina entrance, and back to the slip. No boat shall constitute a sinking, pollution, or fire hazard.

34. In the event of emergency during the absence of the slip or boat owner, or user, HBHYC has the right, but not the obligation, to make necessary repairs and/or secure the boat. The cost shall be borne by the slip owner and/or boat owner.

35. All vessels shall be covered by adequate hull or casualty insurance in an amount equal to at least 80% of the vessel’s current market value and liability insurance in an amount acceptable to HBHYC.  Said insurance shall name HBHYC as an additional insured party and shall provide ten (10) days prior notice to HBHYC of cancellation of the policy for any reason. Prior to use of slip, a Certificate of Insurance shall be provided to the Association.

36. Prior to mooring, all boat Owners shall supply the Association with the following information regarding the craft to be moored at the slip:

– Boat Name
– Length/Beam/Draft
– Manufacturer/Year Made
– Type of Power/SaiI Configuration
– Type
– N.J./USCG Registration Number
– Insurance Company/Policy No./Agent Name and Telephone Number
– Arrival Date
– On Board Telephone Number
– Radio Call Name Letters, or Numbers
– Owner’s Name, Home and Business Address, and Home and Business Telephone Numbers

37. Small Vessels in Marina:

Small and personal type watercraft such as PWC’s (Jet skis), Paddleboards, Windsurfers, ” E-Foils”, Kayaks, Canoes, Inner tubes and floats, etc., are only allowed while egressing and ingressing the marina from/to the owners slip.  Extreme care must be taken because they are not easily visible to larger boats.  Swimming is forbidden within the marina. Diving is allowed only for maintenance purposes.


38. Sailing: Sails cannot be used for power or navigation within Marina confines.


39.  Houseboats/Houseboat barge:   Houseboat /barges are prohibited from occupying a slip at the marina. A “Houseboat/Houseboat barge ” is defined as a craft designed primarily as a residence and not as a mode of regular transport.  This will include any vessel with a ” barge-shape” hull.

Additional definition: “Houseboat” means a watercraft or recreational or industrial / commercial structure on or in the water, floating or non-floating, which is designed or fitted out as a place of habitation and is not principally used for transportation.

40. The HBHYC work/safety boat will utilize vacant slips as needed. If the slip is needed by the owner or tenant, contact the marina office / manager by radio or telephone and the work boat will be relocated.

41. Absolutely no fireworks of any kind are permitted anywhere on HBHYC property or the Marina unless part of a display specifically organized and conducted by HBHYC.

42. Except as provided by law, firearms and weapons of any kind are not permitted on HBHYC property.

43. Members, renters, and guests should not request personal services from employees of the Club on duty.  Staff are not permitted to work on boats on HBHYC property. Personal use of Club property including furnishings and equipment is not permitted.

44.  Marina Management and HBHYC have authority to enforce these Rules and Regulations and infractions will be reported to the Board of Trustees.

In addition to any other restrictions, whether of record or otherwise, which will limit, impair, or restrict the use of the HBHYC Property, the above restrictions exist and apply to all owners, lessees, their guests and invitees.

HBHYC reserves the right to amend or modify these Rules and Regulations, and shall notify the membership of any such changes.

Policy and Rules for Events at High Bar Harbor Yacht Club

This list of Regulations begins with the indication that The Club and its Facilities are “a private recreational space, not a public event space”. 

These limitations are deemed necessary to avoid multiple issues such as interfering with usage of club facilities by owners and tenants, liability of numerous types (notwithstanding that our existing insurance may not allow the hosting of outside events), safety and security, damage and cleanup issues, noise, parking, and other disturbances to the local neighborhood, etc. Also, importantly, we cannot charge for the use of the facility since we are a non-profit organization in the eyes of the IRS.

Regulations

A)  Events at HBHYC must be sponsored by an Owner, and if it is not designated as an event for all Owners, then it should be noted that Owners in general cannot be excluded. Tenants and non-members cannot sponsor such events.  Officially recognized groups within the club (such as The Barnegat Inlet Yacht Club) will follow the same rules as Owners.

B) No event of any type shall restrict use of any common facilities to any other Owner or tenant, including the clubhouse, kitchen, grills, bathrooms, deck, pool, docks, or parking lots.

C) Although guests of owners are allowed, there is a limitation on the overall number of such guests.  It should be noted that the maximum allowable capacity according to local fire code is 72 people within the Clubhouse lounge total. This number cannot be exceeded.

D) All requests for an organized event greater than 30 people needs to pass through The Board of Trustees.

E) Surrounding grounds such as the parking lot and pool are not allowed for designation as event space.  Erection of tents for such purpose is also prohibited.

F) These regulations are in force regardless of the time of year or day of the week.

This policy was approved by the High Bar Harbor Yacht Club Board of Trustees on February 10, 2023, and is noted in the Minutes of the monthly meeting of that same date.)
